1. SafeHaven’s role & reliance on uploaders

SafeHaven is a platform that hosts content created and uploaded by its members; with limited exceptions, Champlin Enterprises does not produce the user-generated content that appears on the Service. To the extent any content on SafeHaven is subject to 18 U.S.C. §2257 or §2257A, the obligation to create and maintain the required age-verification records rests with the uploader/producerof that content, who SafeHaven requires to be the custodian of those records (or to have designated one). SafeHaven relies on each uploader’s representations and records, as set out in the Terms of Service.

2. Uploader obligations

By uploading or generating any image, video, or other depiction on SafeHaven, you represent, warrant, and agree that:

• every person depicted was at least 18 years old at the time the content was produced;
• you have verified the age and identity of every person depicted and hold the records required by 18 U.S.C. §2257 / §2257A where applicable;
• you are (or have lawfully designated) the custodian of records for that content and will make those records available to the extent required by law;
• you have all rights, consents, and releases from each person depicted; and
• the content complies with our Community Guidelines, Acceptable Use Policy, and all applicable law.

3. Custodian of records

For any content for which Champlin Enterprises is deemed a producer under the applicable regulations, the records required by 18 U.S.C. §2257 and §2257A are kept by the Custodian of Records at:

For content produced by members and other third parties, the custodian of records is the uploader/producer of that content, as described above.

4. Zero tolerance for minors

SafeHaven has absolute zero tolerance for content depicting or involving minors. Any such content is removed, preserved, and reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by law, and the responsible account is terminated.
